Welcome to ThermometerExpert! The terms "we", "us" and "our" refer to ThermometerExpert B.V., registered at De Nieuwe Erven 3, unit 13804, 5431 NV Cuijk, the Netherlands. ThermometerExpert operates this store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a personalized shopping experience (the "Services"). ThermometerExpert is powered by Shopify, which enables us to deliver the Services to you.

These general terms and conditions ("Terms") describe your rights and obligations when using the Services. By visiting or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Services.

Article 1 – Applicability & Definitions

These Terms apply to all offers by ThermometerExpert and to every agreement concluded between ThermometerExpert and a Buyer, both to Consumers (natural persons not acting in the exercise of a profession or business) and to Business Buyers (B2B).

Where a distinction is necessary in these Terms, this is explicitly indicated as "Consumer" or "Business Buyer". Mixed/general provisions apply to both.

Deviations are only valid if confirmed in writing by ThermometerExpert.

Article 2 – Access, Account and Accuracy of Data

You are responsible for your account security and for providing correct, current and complete data.

Article 3 – Product Information

We strive for the most accurate representation possible; minor deviations (e.g., color/screen) may occur. Changes in specifications/assortment may take place without prior notice.

Article 4 – Order Process & Conclusion

Your order is an offer; the agreement is concluded after order confirmation by ThermometerExpert (e.g., by email).

Check your order before shipping; cancellation after acceptance may no longer be possible.

Returns are only possible in accordance with Article 9 (Right of Withdrawal & Returns) and our Return Policy.

Article 5 – Prices, VAT and Payment

All prices are in euros and inclusive or exclusive of VAT as indicated in the shop, and exclusive of shipping and any customs costs, unless otherwise indicated.

Payment is processed via the offered payment methods. You guarantee that you are authorized and that the payment details are correct.

Promotions/discounts may have conditions; in case of conflict between promotion conditions and these Terms, the promotion conditions take precedence to the extent they are specific.

Article 6 – Shipping, Delivery and Transfer of Risk

Stated delivery times are indicative. Delays due to carrier/customs are outside our control.

Consumers: the risk of loss/damage only transfers upon actual delivery to the Consumer or a designated third party (not the carrier).

Business Buyers: the risk transfers upon handover to the carrier (unless otherwise agreed in writing).

The sender address ("shipment from") may be the actual fulfillment location. The return address may differ and is provided (where applicable) after RMA approval.

Article 7 – Retention of Title

Delivered products remain the property of ThermometerExpert until full payment has been received. Until then, you may not pledge or otherwise encumber the products.

Article 8 – Intellectual Property

All (intellectual) rights to content, trademarks, texts, images, etc. rest with ThermometerExpert or its licensors. Reuse without prior written permission is not permitted.

Article 9 – Right of Withdrawal & Returns

A. Consumers

For distance selling, you have a 14-day right of withdrawal after receipt, unless a statutory exception applies.

Exclusion for individually calibrated thermometers: our thermometers are individually calibrated before shipping and provided with a traceable calibration certificate. This calibration makes the product unique as the measurements and certificate only apply to that specific device.

Resale as new or recertified product is therefore not possible.

We therefore exclude the right of withdrawal for these products based on Article 6:230p sub e of the Dutch Civil Code, from the moment the individual calibration has been initiated.

During the ordering process, we inform you clearly and request your explicit consent (checkbox) to start the calibration before the withdrawal period expires, and that you understand that the right of withdrawal lapses for this product.

For products to which the right of withdrawal does apply: you can cancel within 14 days; you will then receive instructions. You are responsible for any reduction in value from handling beyond what is necessary to establish the nature, characteristics and functioning of the product. Refund follows after receipt and inspection, within 14 days of cancellation (we may wait until receipt or proof of return).

Other statutory exclusions remain applicable (including sealed hygiene products after seal breakage, perishable goods, digital content without a medium with consent).

B. Business Buyers

For B2B sales, there is no statutory right of withdrawal. Returns are only possible with prior written approval (RMA) and in accordance with conditions set by ThermometerExpert.

Article 10 – Warranty

Limited manufacturer's warranty of 12 months from delivery, against material and manufacturing defects, under normal and intended use in accordance with the manual and specifications.

Exclusions: (a) wear and tear; (b) improper use, drop/impact/moisture/water damage; (c) repairs/modifications by third parties; (d) use contrary to manual/specifications; (e) incorrect storage/cleaning; (f) calibration drift outside the recommended calibration interval.

Remedies: at the discretion of ThermometerExpert: repair, replacement or (partial) refund. Replacement parts may be new or refurbished.

Consumer rights remain unaffected: this commercial warranty is in addition to the statutory rights regarding conformity (Art. 7:17 Dutch Civil Code et seq.). In case of non-conformity, you have statutory rights regardless of this warranty.

Business Buyers: warranty is limited to what is set out in this article; additional/implied warranties are excluded to the extent permitted by law.

Article 11 – Complaints Procedure

Submit complaints via support@thermometerexpert.com with order number, description and relevant photos.

We will confirm receipt and respond substantively within 14 days.

Consumers in the EU: if your complaint cannot be resolved, you can use the European Commission's ODR platform: https://ec.europa.eu/consumers/odr/

This article does not affect mandatory consumer protection law.

Article 12 – Feedback & Reviews

By posting feedback/reviews, you grant a non-exclusive, worldwide, royalty-free license for use in connection with the performance, evaluation and promotion of the Services, to the extent permitted by law. Unlawful or misleading content may be removed.

Article 13 – Errors and Changes

Obvious errors in prices/stock give us the right to correct/cancel. We may update information and change offers.

Article 14 – Prohibited Use

Misuse, infringement, unlawful or disruptive use of the Services is prohibited. In case of violation, we may block accounts and recover damages.

Article 15 – Liability

We are not liable for indirect/consequential damages, loss of profits or data loss, except where mandatory law provides otherwise.

Consumers: we do not exclude liability for death/injury caused by our intent or gross negligence, nor for product liability or other liability that cannot be excluded by law.

Business Buyers: total liability is limited to the invoice amount of the delivery to which the liability relates, unless there is intent or gross negligence.

Article 16 – Force Majeure

We are not obliged to perform in case of force majeure (including disruptions at suppliers/carriers, pandemic, natural disaster, war, government action) for as long as the force majeure continues.

Article 17 – Indemnification (B2B)

Business Buyers indemnify ThermometerExpert against claims from third parties arising from use that is not in accordance with specifications/manual or from their own resale/onward delivery.

Article 18 – Relationship with Shopify

You acknowledge that Shopify is not responsible for sales-related aspects between you and ThermometerExpert and that you indemnify Shopify against claims arising from your transactions with ThermometerExpert.

Article 19 – Privacy

Processing of personal data is done in accordance with our Privacy Policy and – where applicable – Shopify's privacy statement.

Article 20 – Transfer

You may not transfer rights/obligations without our prior written consent. We may transfer our rights/obligations to the extent permitted by law.

Article 21 – Governing Law & Jurisdiction

These Terms and all agreements are governed by Dutch law. Disputes will be submitted to the competent court in Utrecht, unless mandatory law designates another court or we choose another competent court permitted by law. For Consumers, the court designated by law applies.

Article 22 – Changes

You can always find the most recent version of the Terms on our website. We may modify these Terms; material changes will be communicated in accordance with the law. Use after modification constitutes acceptance.
